Seized Chatham apartment sale draws interest

Interest is high in the sale of a Chatham apartment building forfeited to the Crown by a court order last year.

The property at 51 Taylor Ave. has garnered “quite a few offers” since going on the local real estate market last week, Excel Realty Services broker Dan Gagner told The Chatham Daily News Monday.

Gagner said he had a minimum of seven offers for the property, with more expected.

However, proceeding with the actual sale of the property is in a state of limbo.

The Daily News has learned a notice of motion has been filed in the Court of Appeal to argue against the forfeiture.

A London law firm, which represented the owner in an application to argue the case earlier this year, was unaware of the property being listed for sale by the Crown when contacted by The Daily News.

The papers were filed at court the same day.

A spokesperson for the Ministry of the Attorney General said the notice of motion is returnable in the Court of Appeal on Aug. 1.

The property was found to be an “instrument of unlawful activity” by a Superior Court judge and was ordered forfeited to the Crown under the Civil Remedies Act in November 2012.

In his ruling, the judge noted the level of police activity to investigate drug-related offences at more than one unit spanning several years.

The property is listed for $230,000, almost half of its assessed value.

Gagner said offers are still being accepted.

“Hopefully things will progress and someone will take it over and make it a nice property,” he added.

The sale price reflects needed repairs, said Gagner.

Seven of the 12 units are currently rented.

The property listing shows tenants pay $600 a month, which includes utilities.
