“Yooralla has learnt that a former casual staff member who was accused of sexually assaulting five clients with disability in late 2011 and early 2012 has pleaded guilty to 12 offences. The matter has now been listed for sentencing at the County Court on 5th June.

Yooralla General Manager, Jennifer Boulton said, “While nothing can undo the pain and suffering of the victims, we do hope this plea provides some comfort to victims and their families.”

“We applaud the victims for their bravery in coming forward to report these very serious allegations and we will continue to do all we can to support them, their families and the other staff involved,” Ms Boulton said.

The former Yooralla casual employee was investigated for an alleged sexual assault in late 2011. At that time there was insufficient evidence, either from the police investigation or from Yooralla’s internal investigation to justify dismissal. However, a written warning was issued. The staff member was returned to work at another location where he subsequently verbally abused a staff member. At this point disciplinary processes were commenced but the employee resigned. It was some weeks later that further allegations of sexual assault were made by Yooralla clients.

Yooralla immediately informed police and instigated communication with the families of those clients directly affected.

Extensive steps were immediately taken by the Yooralla Board and management to review client safety and wellbeing. These included commissioning Mr Brian Joyce, a former Regional Director with DHS, to conduct an external independent report into the circumstances of these events and to identify recommendations to enhance client safety.

The Yooralla Board has accepted all 20 recommendations contained in the Joyce Report. The report recommended further enhancements to systems, procedures and preventative measures to improve the safety and wellbeing of clients. Many of these built on the work that had already been initiated as part of Yooralla’s initial response to the emergence of the allegations.

Improvements focus on:

• changes to the way Yooralla manages casual and relief staff;

• changes to procedures and training for the reporting and investigation of allegations of assault;

• the establishment of a dedicated division to strengthen quality innovation and safeguards
