Lawyer seeks to block PSC list

A Nairobi lawyer has moved to court seeking to stop the Public Service Commission from forwarding the names of candidates selected for appointment to the commission to spearhead the implementation of the new Constitution.

Saying that the process to pick the eight names was flawed, lawyer Charles Mong’are Ongoto wants the Public Service Commission stopped from forwarding the names to President Kibaki for approval by Parliament.

He further argues that the commission took into consideration irrelevant factors.

In a notice filed at the High Court in Nairobi Monday, Mr Ongoto argues that the decision by PSC to shortlist and interview 50 candidates when it had 425 candidates eligible for the eight positions was an abuse of power.

According to him, the Commission had the discretion to exclude other applicants from the interview panel.

He further said that the decision by the Commission to exclude other qualified applicants from the interview was unreasonable and unfair.

Mr Ongoto says that he applied and was short-listed for the interview but he was excluded from the process.

The lawyer further questions the criteria used to select the 50 candidates short-listed for the eight positions.

In the notice, Mr Ongoto will also be seeking orders to quash the interviews conducted by the Commission between November 20 and 21.

    Let the law that was to guide the process be followed to the letter. If the law was not followed, then the selection ought to be re-done. As a society we must begin to be ruled by law not the whims of a few characters who think everyone else is literary ‘THICK’!!!

    Didn’t i say here that our country is becoming too legalised that soon lawyers will now want to be headmasters.

    Unlike the Committe of experts this group are doomed to fail because of their prior political affiliation and interest.So good work mr lawyer for trying to stop the process from being hijacked by politicians who are fronting for political parties and personalities
